Terms of Service

By accessing and using Virgil ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use this service.

Virgil is an AI photo generation app for iOS. The service includes:

• •AI-powered photo generation using templates
• •AI-powered photo editing using custom prompts
• •Custom image upload functionality
• •Save and share generated images

When using our service, you agree to:

• •Provide accurate information when creating an account
• •Use the service only for lawful purposes
• •Not upload inappropriate, offensive, or copyrighted content
• •Respect intellectual property rights
• •Not attempt to reverse engineer or hack the service

Virgil offers a weekly Pro subscription. By subscribing, you agree to the following:

• •Subscriptions are billed weekly through Apple's App Store
• •Charges are made to your Apple ID account at confirmation of purchase
• •Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• •You can cancel anytime via Settings → Apple ID → Subscriptions on your iPhone
• •No refunds are provided for partial subscription periods
• •We may modify subscription features and pricing with reasonable notice

Regarding content and intellectual property:

• •You retain ownership of photos you upload
• •You grant us permission to process your images for AI generation
• •Our AI technology and templates are protected by copyright
• •You may not redistribute or resell our content
• •Generated images are for personal use only

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the service, you consent to the collection and use of information as outlined in our Privacy Policy.

The service is provided "as is" without warranties of any kind:

• •We do not guarantee the accuracy or quality of AI-generated results
• •Actual generated results may vary from previews or examples shown
• •The service may have technical limitations or interruptions

To the fullest extent permitted by law:

• •We are not liable for any indirect, incidental, or consequential damages
• •Our total liability shall not exceed the amount you paid for the service in the prior 30 days
• •Users assume full responsibility for how they use generated content

You are solely and fully responsible for any and all actions you take using this app. Virgil and Flamme Labs are not liable, directly or indirectly, for any illegal, harmful, or unauthorized activity conducted through or facilitated by the use of this service. This includes but is not limited to:

• •Any violation of local, national, or international laws or regulations
• •Any misuse of AI-generated content for fraud, impersonation, or deception
• •Any harm caused to third parties through content you create or share
• •Any intellectual property infringement arising from your use of the service

By using Virgil, you agree to indemnify, defend, and hold harmless Flamme Labs, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or your violation of these terms.

Our service utilizes third-party AI technologies to provide generation features. By using our service, you acknowledge and agree that:

• •Your images may be processed by our AI service providers
• •You must comply with our AI providers' acceptable use policies
• •We may update or change AI providers without prior notice
• •Third-party service availability may affect our functionality

In accordance with our AI service providers' policies and applicable laws, you may not use the service for:

General Prohibited Uses:

• •Any unlawful purpose or activity
• •Violating any intellectual property rights
• •Transmitting viruses or malicious code
• •Commercial use without authorization
• •Circumventing our safety filters or abuse protections

Content Restrictions — You may not upload or generate:

• •Content relating to child sexual abuse or exploitation
• •Content that facilitates violent extremism or terrorism
• •Non-consensual intimate imagery
• •Content that facilitates self-harm
• •Sexually explicit content
• •Content promoting hatred, harassment, bullying, or violence
• •Content that violates others' privacy rights or uses personal data without consent
• •Content intended for fraud, scams, or deceptive practices
• •Content that impersonates individuals to deceive others

Age and Safety Restrictions:

• •Images of minors (under 18) without verifiable parental consent
• •Content that could facilitate harm to minors
• •Images that track or monitor people without their consent

Important disclaimers regarding AI-generated content:

• •All results are AI-generated
• •AI results may contain inaccuracies, artifacts, or unexpected variations
• •We cannot guarantee the accuracy, completeness, or suitability of AI outputs
• •AI processing is subject to the terms and limitations of our third-party providers

To ensure compliance with these terms and our AI providers' policies:

• •We may monitor uploaded content using automated systems
• •Prohibited content will be automatically rejected or removed
• •Repeated violations may result in account suspension or termination
• •We reserve the right to refuse service to users who violate policies

We reserve the right to terminate or suspend any account at any time, with or without notice, for any reason including but not limited to violation of these terms, suspected abuse, or at our sole discretion. You may also terminate your account at any time using the account deletion feature in the app or by contacting us.

Users must be at least 13 years old to use this service. Users under 18 should have parental supervision and consent. We do not knowingly process images of minors without proper consent.

We reserve the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the service constitutes acceptance of the modified terms.

These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
